3. Artificial Intelligence Variance and Technological Limitations
You acknowledge and agree that the Service relies on experimental artificial intelligence (AI), machine learning models, and third-party data pipelines. AI models are subject to predictive variance, latency, computational errors, and "hallucinations" (the generation of plausible but factually incorrect or illogical data). 4. Subscription, Billing, and Cancellation Policy
Access to premium features requires a paid subscription. By providing a payment method, you authorize our third-party payment processor (Lemon Squeezy) to charge the applicable subscription fees on a recurring basis. All subscription charges are final and non-refundable. Because the Service delivers immediate access to proprietary digital content and cloud-computing resources, you acknowledge that standard consumer cooling-off periods are waived upon your immediate access to the digital content. You may cancel your subscription at any time through your account settings. Upon cancellation, your access to the premium Service will remain active until the end of your current paid billing cycle. We do not provide prorated refunds or credits for partially used billing periods.
5. Intellectual Property and Third-Party Data
All proprietary software, UI/UX designs, algorithms, databases, and source code associated with SaPEX NEXUS are the exclusive intellectual property of the Company and are protected by international copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You are strictly prohibited from scraping, reverse-engineering, redistributing, or framing our data. Furthermore, the Service aggregates market data from third-party APIs. You acknowledge that this third-party data remains the intellectual property of its respective owners, and SaPEX NEXUS makes no claim of ownership over external market pricing or news feeds.
6. Limitation of Liability and Indemnification
To the maximum extent permitted by applicable law, SaPEX NEXUS, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, capital, or goodwill, arising out of your access to or inability to access the Service.
